A military leave of absence is governed by the Uniformed Services Employment and Reemployment Rights Act (USERRA), which protects the employment rights of individuals who leave their task to serve in the military.

Returning to Work After Military Leave

Reemployment needs to include confirmation of the employee's good standing with the military to return to work and must abide by these USERRA provisions:

  • If the absenteeism is for a period of xxx days or less, the employee must written report to piece of work on the next full, regularly scheduled workday, plus 8 hours.
